Terms of Service

Acceptance of Terms

Effective date: 10/12/26

These Terms of Service (“Terms”) govern your use of vivavolt.us (the “Site”) and your purchase of products or services from Vivavolt (“Vivavolt,” “we,” “us,” or “our”), located at 50 Kearney Rd, Ste. 11, Needham, MA 02494.

By using the Site, contacting us, or buying from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Installation and service projects are also governed by a separate written agreement signed by you and Vivavolt. If that agreement conflicts with these Terms, the signed agreement controls.

Use of the Site

You must be at least 18 years old to request services or make purchases through the Site. You agree to provide accurate information when you contact us, request a quote, or place an order.

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose.
  • Submit false information or impersonate another person.
  • Interfere with the Site’s security or operation, including by uploading malware or attempting unauthorized access.
  • Copy, scrape, or reuse Site content for commercial purposes without our written permission.

We may suspend or restrict access to the Site at any time if we believe these Terms have been violated.

Quotes, Estimates, and Service Agreements

Quotes and estimates for solar, battery backup, heat pump, generator, and EV charger installations are based on the information available at the time. Final pricing may change after a site assessment, or if site conditions, equipment availability, permit requirements, or utility requirements differ from what was expected.

Unless stated otherwise, a quote is valid for 30 days. A quote is not a binding contract. Work begins only after you and Vivavolt sign a written service agreement, which sets out the scope of work, price, payment schedule, timeline, and warranty terms.

Project timelines are estimates. Delays caused by permitting, inspections, utility approvals, weather, or supply issues are outside our control.

Product Purchases

Pricing and availability. Prices and product availability are subject to change without notice. We try to keep product information accurate, but errors may occur. If a product is listed at an incorrect price, we may cancel the order and refund any payment.

Payment. Payment is due at the time of order unless we agree otherwise in writing. Payments are processed by third-party payment providers.

Shipping. Delivery dates are estimates. Risk of loss passes to you when the product is delivered to the shipping address you provide.

Returns. Unused products in original packaging may be returned within 30 days of delivery for a refund, less shipping costs and any restocking fee of up to 15%. Installed, used, or custom-ordered products cannot be returned. Contact us before returning any product.

Installation. Many products, including EV chargers and generators, require installation by a licensed electrician or qualified installer and may require a permit. Improper installation may void the manufacturer’s warranty.

Rebates, Incentives, and Savings Estimates

Information on the Site about tax credits, rebates, and incentive programs (such as Mass Save or federal tax credits) is for general information only. Program rules, amounts, and eligibility change often and are set by third parties. Vivavolt does not guarantee that you will qualify for or receive any incentive.

Vivavolt does not provide tax, legal, or financial advice. Please consult a qualified tax professional about your eligibility for any tax credit.

Energy production, savings, and payback estimates are projections based on assumptions about weather, usage, utility rates, and equipment performance. Actual results will vary and are not guaranteed.

Utility interconnection, permits, and inspections are approved by third parties. We will help you apply, but we cannot guarantee approval or timing.

Warranties, Disclaimers, and Limitation of Liability

Manufacturer warranties. Equipment is covered by the manufacturer’s warranty, if any. Vivavolt’s workmanship warranty, if provided, is described in your signed service agreement.

Site disclaimer. The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Vivavolt disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as stated in a signed agreement.

Limitation of liability. To the fullest extent permitted by law, Vivavolt is not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost savings, or loss of data, arising from your use of the Site or our products. Our total liability for any claim relating to the Site or a product purchase will not exceed the amount you paid for the product or service involved.

Some laws do not allow certain disclaimers or limitations, so some of the above may not apply to you. Nothing in these Terms limits rights you have under Massachusetts consumer protection law that cannot be waived.

Intellectual Property, Third-Party Links, and Indemnification

  • Intellectual property. The Site’s content, including text, images, logos, and design, belongs to Vivavolt or its licensors. You may view and print content for personal, non-commercial use only. Manufacturer names and logos belong to their respective owners.

Third-party links. The Site may link to manufacturer, utility, incentive program, or social media sites. We do not control these sites and are not responsible for their content or practices.

Indemnification. You agree to indemnify and hold Vivavolt harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site.

Governing Law, Changes, and Contact

Governing law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Norfolk County, Massachusetts, unless your signed service agreement provides otherwise.

Informal resolution. Before filing a claim, please contact us so we can try to resolve the issue informally.

Changes to these Terms. We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Continued use of the Site after changes means you accept the updated Terms.

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
